Stat. § 471.705 (1992), the conduct complained of must amount to either malfeasance or nonfeasance under Article 8, Section 5 of the Minnesota Constitution. 2. An elected official whose conduct constitutes either malfeasance or nonfeasance and who engages in three, separate, intentional,and unrelated violations of the Open Meeting Law must be removed from office.
